 softener drain air gap

I am installing a water softener and am concerned that I am meeting the drain air gap requirement. My initial plan is to direct connect the 1/2" drain line to an existing 1 1/2" standpipe. I would use a threaded connector to the top of a 1 1/2" Y and leave the side open for the gap. This should allow about an 1 1/2 gap for any possible overflow. Sound like that meets the gap code?

Not here in NC. Bacteria and other bad stuff can still come up and into 1/2" pipe. It must, by code, have a clear air gap.
