the drain pump for the washing machine is not working properly. The water is backing up and it seems to be coming out of the sides of the pump that are sealed and the pump seems to run and not shut off... any idea If I need a new pump or what the problem may be?

Possibly a blockage in the drainage system. The pumps unable to discharge the water, the float stays up, the pump keeps running.
Or it could be that the pumps worn out, is there a check valve and union on the discharge piping ?

I HATE WHEN THAT HAPPENS. Water pumps have floats and your discharge pipe to the waste line might be plugged or clogged with lint soap grease and debris from washing over the years. How old is your system? A licensed plumber will know exactly what to do and mostly like will offer a warranty when the job is done. You will have peace of mind.

Best Wishes
